1. Account creation
We create your account after we have confirmed your payment and its legitimacy. It is your responsibility to provide us with a valid email account to send you important information regarding the products and services you hire from us.
2. The Content
All services provided by HostingHQ.net can only be used for lawful purposes. This includes but is not limited to: copyrighted material, material we judge to be offensive or obscene, pornography. The client agrees to compensate and keep HostingHQ.net out of any dispute or claim that results from the use of our services.
Examples of unacceptable material:
IRC Bots, Warez Sites, Pirate Software, movies and music, hate and racism sites, hacker files and software.
3. Zero tolerance Spam policy
We have a zero tolerance towards spam and mass emailing. Opt in mailing lists and safe lists will be treated as spam. Any user sending spam will be suspended without a warning. Please read www.HostingHQ.net/mailpolicy.php
HostingHQ.net reserves the right to require changes or suspension of websites, accounts, data bases or any other service that in our opinions not in compliance with this policy. HostingHQ.net also reserves the right to make any emergency modification that we see fit..
HostingHQ.net reserves the right to charge the account that was used to send any unsolicited email a clean up fee. This fee will be set by HostingHQ.net. All rights reserved.
4. Payment information
You agree to provide payment for the services provided by HostingHQ.net, in advanced for the period that those services are being hired for. You agree that until you notify HostingHQ.net of your wish to terminate any of the services hired, these will be charged on a regular basis.
HostingHQ.net reserved the right to change the monthly fee and any other charges at any time.
5. Backups and Data Loss
HostingHQ.net will not be held responsible for files and data that you host in your account. You agree to take responsibility of the files and data transferred and to maintain regular backups of the data and files hosted in HostingHQ.net′s servers.

7. The use of resources
Users cannot initiate the following:
a) Using 25% or more for a period longer than 90 seconds. There are several activities that could cause such a problem, such as: CGI scripts, FTP, PHP, HTTP, etc.
b) Run any type of real time chat applications that require resources from the server. Remotely hosted services are permitted.
c) Initiated automatic unattended processes at any moment on the server. This includes any and all deamons, like IRCD.
d) Initiate any software of IRC interface (Internet Transmited Chat).
e) Initiate any bit torrent
f) Initiate any game server like counter-strike, half-life, battlefield1492, World of Warcraft, etc.
8. Bandwidth usage
You have a monthly bandwidth allowance. This allowance varies depending the hosting plan you purchase. If you surpass the permitted bandwidth we reserve the right to suspend your account until the start of your next allowance, suspend the account until you purchase extra bandwidth, upgrade to a larger plan or terminate your account and charge you for any extra bandwidth you may have used. The unused monthly bandwidth is not accumulated to the following month.
9. Indemnity
The client agrees that he/she will defend, protect and indemnify HostingHQ.net innocent from any and all lawsuits, responsibilities that come from (1) any damage to a person or property resulting from a product sold or distributed in connection to HostingHQ.net; (2) any material supplied by the client infringing or allegedly infringing the rights of third parties; (3) property transgression and (4) any defective products sold from the HostingHQ.net servers.
10. Abstention
HostingHQ.net will not be held responsible for any harm that your business may suffer. HostingHQ.net does not make any guarantees of any kind, expressed or implicit about the services we provide. HostingHQ.net rejects any guarantee or aptitude for a particular purpose. This includes data loss that results in delays, failed deliveries, wrong deliveries and any service interruption caused by HostingHQ.net and its staff.

11. Changes to these Terms
HostingHQ.net reservs the right to ammend its policies at any time without previous announcement.
